FTC cracks down on AI startup Air AI for deceptive marketing schemes
The U.S. Federal Trade Commission (FTC) has taken strong action against AI startup Air AI for misleading entrepreneurs and small businesses. The company falsely marketed its products as advanced 'conversational AI' capable of replacing human staff and guaranteeing high profits. A court order has now finalised a settlement with significant penalties. Air AI deceived customers by claiming its technology could fully automate customer service and deliver substantial financial returns. The company also promised money-back guarantees but failed to honour them, generating millions in revenue through false advertising.
Under the settlement, Air AI and its operators are permanently banned from selling business opportunities. They are also prohibited from making misleading claims about any products or services in future sales and telemarketing efforts. A federal court imposed an $18 million judgment against the company, though most of the penalty was suspended due to Air AI's financial struggles. Instead, the operators will pay $50,000 to the FTC for consumer redress. This case is part of a wider FTC crackdown on 'AI washing'—where companies exaggerate or falsely advertise AI capabilities. While no firms have been officially sanctioned for this since 2023, the agency has intensified enforcement. Similar actions include the Securities and Exchange Commission's 2025 case against Presto Automation for misleading investors about its AI technology.
The ruling bars Air AI from further deceptive practices and requires financial compensation for affected customers. The FTC's action signals stricter oversight of AI marketing claims, aiming to protect businesses from false promises. Future cases may follow as regulators target similar misconduct in the industry.
